Deceptive Practices

Unfortunately, deceptive practices appear to be at an all time high. Over the past decade, big businesses have routinely immunized themselves from liability by inserting binding mandatory arbitration clauses with class action bans in consumer contracts. Check your credit card agreement, for example. Most people do not even realize that such clauses exist in their contracts. Even where people are aware of these door-closing clauses, they do not fully understand the significant legal consequences, and trust the kangaroo courts masquerading as "independent" arbitration providers to protect their rights. With such “bill stuffing” amendments to agreements, and a staunchly anti-plaintiff environment, consumer rights have seldom been under so much attack. Deceptive practices by businesses are usually unlawful under consumer protection laws of various states. For example, in New York, Section 349 of the General Business Law prohibits deceptive practices. These laws are usually very broadly worded and cover most businesses. They permit claims which are usually easier to prove than traditional common law claims.
